​Liability Disclaimer, Assumption of Risk, and Product Use Terms
By purchasing, possessing, handling, transporting, or using any product supplied by Canadian Tactical Solutions ("CTS"), the purchaser and end user acknowledge and agree to the following Terms and Conditions.
1. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict of law principles.
Any dispute, claim, or proceeding arising from or relating to the purchase, possession, transportation, storage, handling, or use of CTS products shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
2. Compliance with Applicable Laws
The purchaser and end user are solely responsible for ensuring compliance with all applicable municipal, provincial, territorial, federal, and international laws, regulations, licensing requirements, import and export controls, and restrictions relating to the purchase, possession, transportation, sale, storage, and use of CTS products.
Where body armor, protective equipment, or related products are regulated within a purchaser's jurisdiction, the purchaser represents and warrants that they are legally entitled to purchase, possess, and use such products and that all required permits, authorizations, licenses, or exemptions have been obtained prior to purchase.
3. Eligibility to Purchase
By placing an order with CTS, the purchaser represents and warrants that:

They are at least eighteen (18) years of age, or the age of majority in their jurisdiction, whichever is greater;

They are legally permitted to purchase, possess, transport, and use the products ordered;

They are not prohibited by any applicable law, regulation, court order, or government restriction from purchasing, possessing, transporting, or using such products;

All information provided to CTS in connection with the purchase is accurate, current, and complete; and
-
They are purchasing and using the products in compliance with all applicable laws and regulations.
CTS reserves the right, at its sole discretion, to refuse, cancel, limit, or review any order where eligibility, legal compliance, identity, payment authorization, or regulatory requirements cannot be reasonably verified, or where CTS believes completing the transaction may violate applicable law.
4. Product Performance and Intended Use
CTS products, including ballistic and protective equipment, are manufactured and tested to meet the performance standards, and specifications identified for each product.
When properly fitted, maintained, and used in accordance with applicable instructions, such products are intended to provide the level of protection for which they were designed and tested.
However, ballistic and protective equipment is designed to reduce risk and cannot eliminate all risks associated with hazardous situations. Product performance may be affected by factors including, but not limited to, threat type, ammunition characteristics, impact location, environmental conditions, product condition, fitment, maintenance, storage, and manner of use. Actual performance may vary depending on the specific circumstances of an incident.
5. Assumption of Risk
The purchaser and end user acknowledge that the use of ballistic and protective equipment involves inherent risks.
By purchasing, possessing, handling, transporting, storing, or using CTS products, the purchaser and end user voluntarily assume all risks associated with such activities, including the risk of personal injury, death, property damage, or other loss arising from circumstances beyond the control of CTS.
6. Product Inspection, Care, and Maintenance
The purchaser and end user are solely responsible for inspecting all products prior to use and for following all care, maintenance, storage, handling, and usage instructions provided by CTS or the product manufacturer.
Products that have been damaged, altered, improperly maintained, subjected to excessive wear, contamination, abuse, misuse, unauthorized modification, improper storage, or accidental damage may not perform as intended and should be immediately removed from service.
Failure to properly inspect, maintain, store, or use any product may adversely affect its performance and safety.
7. No Warranty for Misuse, Alteration, or Damage
Any warranty, whether express or implied, shall be void where a product has been subjected to misuse, abuse, neglect, accidental damage, improper storage, improper maintenance, contamination, excessive wear, unauthorized modification, improper handling, or use outside its intended purpose.
CTS reserves the right to determine, in its sole discretion, whether a product qualifies for warranty consideration, replacement, repair, or other remedy.
Nothing in these Terms and Conditions shall limit any rights that cannot be excluded under applicable law.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Canadian Tactical Solutions, its owners, officers, directors, employees, contractors, agents, affiliates, suppliers, manufacturers, distributors, successors, and assigns shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to personal injury, death, property damage, economic loss, lost profits, business interruption, loss of opportunity, or any other loss arising from or relating to the purchase, possession, transportation, storage, handling, or use of any CTS product.
This limitation of liability applies regardless of the legal theory asserted and includes, without limitation, claims arising from misuse, improper use, negligence, unauthorized modification, improper maintenance, improper storage, abuse, normal wear and tear, accidental damage, failure to follow instructions, or use contrary to product specifications.
9. No Professional, Tactical, or Legal Advice
Information provided by CTS through its website, product descriptions, specifications, marketing materials, customer communications, social media content, videos, or other materials is provided solely for general informational purposes.
Such information does not constitute legal, tactical, law enforcement, military, security, safety, engineering, or professional advice.
Purchasers and end users are solely responsible for determining the suitability of any product for their intended application and for obtaining independent professional advice where appropriate.
10. Reservation of Legal Rights
Nothing contained within these Terms and Conditions shall be interpreted as limiting, excluding, waiving, or restricting any rights, remedies, defenses, protections, or obligations available to CTS under applicable law.
CTS expressly reserves all rights and remedies available under the laws of Ontario, Canada, and any other applicable jurisdiction.
11. Acceptance of Terms
By purchasing, accepting delivery of, possessing, handling, transporting, storing, or using any product supplied by CTS, the purchaser and end user acknowledge that they have read, understood, and agreed to these Terms and Conditions and expressly accept the risks and responsibilities associated with the use of the products.
If the purchaser is acquiring products on behalf of any individual, corporation, partnership, government agency, security organization, or other entity, the purchaser represents and warrants that they possess the authority to bind such party to these Terms and Conditions, and such party shall be deemed bound by these Terms and Conditions upon purchase, possession, or use of the products.
